1. About Gene GAMSAT

Gene GAMSAT ("we", "us", "our") operates an AI-powered GAMSAT practice platform accessible at genegamsat.com. We are registered and operate under Australian law. By using our service you agree to these Terms of Service. If you do not agree, please do not use the platform.

2. Service description

Gene GAMSAT provides AI-generated GAMSAT practice questions across Sections 1, 2, and 3, including worked explanations, performance tracking, and essay feedback. The service is intended for educational and practice purposes only.

We are not affiliated with, endorsed by, or associated with the Australian Council for Educational Research (ACER) or any official GAMSAT examining body. Using our platform does not guarantee any particular outcome on the GAMSAT examination.

3. Accounts and eligibility

You must be at least 16 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Account sharing is not permitted. Each subscription is for a single named user. We reserve the right to suspend accounts we reasonably believe are being shared.

4. Free tier

Free accounts are limited to 10 questions per day across all sections combined. This limit resets at midnight UTC. We reserve the right to modify the free tier limits at any time with reasonable notice.

5. Subscriptions and billing

Paid plans are offered on a subscription basis. Depending on your chosen plan, billing occurs monthly, quarterly, or annually. Your subscription renews automatically at the end of each billing period unless you cancel beforehand.

You may cancel your subscription at any time via your account settings or by contacting us at hello@genegamsat.com. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial billing periods already paid.

All prices are in Australian Dollars (AUD) and include GST where applicable. Payments are processed securely by Stripe. We do not store your payment card details.

6. Acceptable use

You agree not to:

• Scrape, copy, or reproduce question content from the platform by automated or manual means
• Share, redistribute, or resell question content generated by Gene GAMSAT
• Attempt to reverse-engineer or extract our AI prompts or question generation logic
• Use the platform for any purpose other than your own personal GAMSAT preparation
• Interfere with or disrupt the platform's infrastructure or other users
• Create multiple accounts to circumvent free tier limits

Violation of these terms may result in immediate account suspension without refund.

7. Intellectual property

All question content, explanations, essay prompts, and materials generated or provided through the Gene GAMSAT platform are owned by Gene GAMSAT or its licensors. You are granted a personal, non-transferable, non-exclusive licence to use this content for your own study purposes during your active subscription.

You retain ownership of any essay text you submit for feedback. By submitting, you grant us a limited licence to process that text using our AI systems solely for the purpose of providing feedback to you.

8. Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be error-free, uninterrupted, or that AI-generated content will be accurate or complete.

GAMSAT practice questions generated by AI may contain errors or inaccuracies. We strongly recommend cross-referencing important concepts with authoritative study resources.

9. Limitation of liability

To the maximum extent permitted by Australian law, Gene GAMSAT's total liability to you for any claim arising out of or related to these terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

We are not liable for any indirect, incidental, special, or consequential damages, including loss of profits, loss of data, or failure to achieve a particular GAMSAT score or academic outcome.

10. Governing law

These Terms are governed by the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Australia.

11. Changes to these terms

We may update these Terms of Service from time to time. We will notify you of material changes by email or by displaying a notice within the platform at least 14 days before the changes take effect. Continued use of the service after that period constitutes acceptance of the updated terms.
